Same Sex Relationship

Same-sex couples now have the same rights as heterosexual couples in the context of de facto relationship law. We regularly represent same-sex partners in dealing with property divisions arising out of the breakdown of relationships, in addition to claims for financial support and the determination of arrangements for children.

A same-sex couple who have lived together on a genuine domestic basis for at least 2 years (or less if they have a child) are considered to be a legal entity for the purpose of family law. Please note that in relation to financial disputes, a person must apply for de facto financial orders within two years of the breakdown of their relationship. After this time a person needs the Court’s permission to apply.
