In circumstances where children are suspected of being harmed or abused, the Department of Communities, Child Safety and Disability Services investigates and if necessary, litigates, to ensure that the child is removed from the situation and placed with appropriate carers.

In such circumstances, the extended family (commonly grandparents or a step-parent) may seek to become involved in the child’s care in lieu of the parent.

The legal and administrative process can be complex and daunting.

We have experience in advocating on behalf of grandparents and other extended family or significant persons to the child, to enable them to participate in that process and step into the legal role of carer for the child and/or seek to spend time with the child.
